PART A – WEBSITE TERMS OF USE

1. Who we are

feelchipper.com (Site) is a website owned and operated by Feel Chipper Pty Limited (ACN 628 771 559) ( Chipper  or  us  or   we  or   our ).

 Chipper is a men’s health company founded in 2018. Chipper provides a telehealth service for doctors consultations and provides prescription and non-prescription products for conditions, from the comfort of wherever they feel most comfortable. Chipper is starting with a focus on helping men with male pattern baldness, but will grow into a platform for a wide variety of issues, including mental health, sexual health & skin care.

 Our Site content and any communication you have with Chipper representatives (other than information you receive from our partner doctors) should not be considered medical advice, or taken to mean that any particular medication or treatment is safe, appropriate, or effective for you.

By using our Site you accept these terms

By using our Site, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use our Site

We may suspend or withdraw our Site

Our Site is made available free of charge.

 To the extent permitted by law, including the Australian Consumer Law, we make no representations, warranties or guarantees, whether express or implied, that our Site, or any content on it, will always be available, uninterrupted or be error-free. We may suspend or withdraw or restrict the availability of all or any part of our Site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.

 You are responsible for ensuring that all persons who access our Site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them. 

Registration and eligibility for registration

You must be a registered member to make orders on our Site.

 When you register and activate your account, you will provide us with personal information such as your name, gender, email address, telephone number, date of birth and shipping address. This information will enable our partner doctors to effectively provide you with online medical consultations to assess whether certain prescription medication is suitable for your use. It is your responsibility to update this information so our records are current, complete and accurate. We will handle all personal information we collect in accordance with our Privacy Policy.

 You consent for us to contact you by email or phone if and when the need arises using the email address and phone number you provide when creating your Chipper account. You agree that all information that you provide to our partner doctors will be true and complete to the best of your knowledge and that you will not purposefully omit to provide any information that could reasonably be judged to be potentially relevant to our partner doctors in providing the service. It is also your responsibility to inform your existing doctor of any medicines our partner doctor prescribes for you.

 You should not register or complete questionnaires on behalf of anyone other than yourself. You agree that you will not create more than one Chipper online account.

 If you are under the age of 18 years, you may not create an account or register as a member. If you are over the age of 18 years, you may create an account or register as a member, provided that you:

  • are within Australia at all times while accessing and/or using our website and related services;
  • possess the legal right and ability to enter into a legally binding agreement with us; and
  • agree and warrant to use our Site in accordance with these terms.

You must keep your account details safe

When you register your account, you will also be required to create a password. You must treat this password as confidential. You must not disclose it to any third party.

 We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

 If you know or suspect that anyone other than you knows your user identification code or password, you must immediately notify us at [email protected] and take immediate steps to resecure your account (including by changing your password). 

Information on this Site

Our Site is provided on an “as is” and “as available” basis, and we make no representations or warranties, express or implied, regarding the operation or availability of our Site.

 The content on our Site is provided for general information only. It is not intended to amount to advice on which you should rely.

 Although we make reasonable efforts to update the information on our Site, to the extent permitted by law, including the Australian Consumer Law, we make no representations, warranties or guarantees, whether express or implied, that the content on our Site is accurate, complete or up-to-date.

How you may use material on our Site

Chipper is the owner or the licensee of all intellectual property rights in our Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

 You may print off one copy, and may download extracts, of any page(s) from our Site for your personal use and you may draw the attention of others to content posted on our Site.

 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

 Chipper’s status (and that of any identified contributors) as the authors of content on our Site must always be acknowledged.

 You must not use any part of the content on our Site for commercial purposes without obtaining a licence to do so from Chipper or its licensors.

 If you print off, copy or download any part of our Site in breach of these terms of use, your right to use our Site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

 If Chipper provides social media features such as the ability to share content, you may take such actions as are enabled by such features.

 You must not delete or alter any copyright, trade mark or other proprietary rights notices from copies of materials from this Site. 

Chipper’s trade mark is registered

“CHIPPER” and all related names, logos, product and service names, designs and slogans are our trade marks or the trade marks of our affiliates or licensors. You must not use such marks without Chipper’s prior written permission unless they are part of material you are using as permitted under the section of these terms entitled “How you may use material on our Site”. Other names, logos, product and service names, designs and slogans on our Site are the trade marks of their respective owners and are used by us under licence. 

Prohibited uses of our Site

You must not do any act that we would deem to be inappropriate, is unlawful or is prohibited by any laws applicable to our website, including but not limited to:

  • any act that would constitute a breach of either the privacy (including uploading private or personal information without an individual’s consent) or any other of the legal rights of individuals;
  • using our Site to defame or libel us, our employees or other individuals;
  • uploading files that contain viruses that may cause damage to our property or the property of other individuals; or
  • posting or transmitting to our Site any non-authorised material including, but not limited to, material that is, in our opinion, likely to cause annoyance, or which is defamatory, racist, obscene, threatening, pornographic or otherwise or which is detrimental to or in violation of our systems or a third party’s systems or network security.
  • If we allow you to post any information to our website, we have the right to take down this information at our sole discretion and without notice.

Linked sites

Where our Site contains links to other sites (including banner advertisements and sponsored links) and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources, and you access third party websites entirely at your own risk and subject to the terms and conditions of use for those websites.

PART B – TERMS OF SERVICE

Partner doctors

Our partner doctors take the same personal responsibility for each patient as they would if they were seeing a patient face to face. The online nature of the Chipper service does not diminish the professional obligations that our partner doctors owe to a patient. 

Prescriptions by partner doctors

You agree that any medicine a partner doctor prescribes will be solely for your own personal use and that you will not allow any other person to take the medicine.

 You agree that before taking any medicine that a partner doctor has prescribed you will read all the information that a partner doctor has provided you with either online or in printed form, you will read the medical information leaflet (if any) that accompanies the medicine or is sent to you by email and you will follow any advice that the dispensing pharmacist provides you with. If the advice that the dispensing pharmacist provides you with contradicts the advice provided by a partner doctor, you agree that you will contact Chipper for further advice before taking the medicine.

 You agree that if a partner doctor prescribes a medicine and you suffer from any noticeable side-effects, you will contact Chipper to allow a partner doctor to fulfil their duty of after-care and provide advice on how best to deal with the side effect.

You agree that by requesting treatment you formally give your informed consent for a partner doctor to prescribe that medicine if appropriate and that you have read the information provided on the Chipper website about possible side-effects, contraindications and the effectiveness of the medicine you are requesting.

 Chipper is not a pharmacy and therefore does not dispense any medicine. Our partner pharmacies will dispense the prescription medication with the presentation of an original script filled by one of our Australian registered medical practitioners.

 Chipper takes no responsibility and makes no warranties, express or implied, in relation to the content of any consultation between you and the doctor. You and the doctor are responsible for the conduct of the consultation and all information or communications made.

 Chipper does not guarantee that an online consultation is the appropriate course of treatment for your particular health care problem. You agree to contact your own doctor immediately should your condition change or your symptoms worsen. If you require urgent care, you should contact your local emergency services immediately. 

Provision of services

To the extent permitted by law, the services are offered on an “as is” basis and used by the patient solely at his or her own risk. Chipper may, among other things, withdraw, suspend or discontinue any functionality or feature of its services. We will try to give you reasonable notice of any suspension or withdrawal of services. 

PART C – TERMS OF SALE

Subscriptions

You may purchase one or more subscriptions from the options available on our Site. All subscriptions include a 2 month supply of treatments and automatically renew unless cancelled at least 5 days before the next billing date or subsequent subscription period. You will be charged the subscription price at the time a checkout is completed. All subsequent charges will occur on a 2-monthly basis thereafter as appropriate, unless cancelled by giving us at least 5 days’ notice before your next billing date or subsequent subscription period. 

Refunds

Subject to any additional rights you may have at law (including under the Australian Consumer Law), the subscription price will be refunded only if:

  • a partner doctor declines the request (the decision to approve or reject a request is at the doctor’s absolute discretion);
  • our money back guarantee, as set out below, applies;
  • an item you have ordered is out of stock; or
  • a product or pricing error is identified.

All charges and prices as shown on our Site are in Australian Dollars and inclusive of GST where applicable and delivery charges. Medicare benefits are not claimable for any Chipper service.

 We do not take refunds on any of our products once they have been dispatched. Due to state health regulations general medicines and prescriptions including any preparation that is taken orally cannot be returned or refunded. This is because once the product has left the pharmacy, the storage conditions of the product cannot be guaranteed and also it is possible the product could be tampered with. Refunds, if applicable, will only be made using the online payment gateway to the card originally used for payment.

 You expressly authorise Chipper to process the payment for the subscription price via your relevant payment method at the time a checkout is completed. We may, upon written notice to you, change the price for your current subscription, to take effect the next time you renew your subscription. 

Delivery of products

After a partner doctor has issued you with a prescription, our pharmacy partners will dispense your medicine. Australia Post will then deliver the medicine via Australia Post Express delivery. If you order non-prescription medication, your medication will be dispatched within 2 to 5 business days into the Australia Post Express network. The delivery standards for Australia Post vary depending on your exact location. For delivery times between specific points, please confirm at Australia Post Express National Network. 

Our partner pharmacies always do their best to dispatch medication on time, but ultimately rely on Australia Post to bring the parcel to your door. Chipper is not liable for any loss or damage (including but not limited to consequential loss) resulting from a failure to deliver in accordance with these timetables.

Discount vouchers

Chipper at its total discretion may from time to time provide discount voucher codes to customers. If these voucher codes are provided personally to a customer, they may not be passed on to or used by any other customers. If these voucher codes are provided to the general public with our express authority, they may be used by anyone. These voucher codes can only be used towards the payment of products purchased from our Site. Every voucher code can only be used once per customer and may not be used in conjunction with any other discounts we offer. Unless otherwise stated all voucher codes expire 1 month after publication. Chipper will determine the content of terms governing voucher codes in its absolute discretion and may amend these terms at any time.

Money back guarantee

Our money back guarantee applies to our hair loss products in accordance with the terms outlined below.

 Chipper provides products that are based on clinical data and research. Whilst our products may not be effective for everyone, we are very confident in the efficacy of our products for most people. If you are not happy with our products within the first 3 months of use, you may request a refund on the products ordered in accordance with the below terms.

The terms and conditions of our money back guarantee are as follows:

  • available only on any subscription products provided by Chipper purchased directly from our website
  • the products must have been taken on a daily basis, as per the instructions on each product;
  • the money back guarantee cannot be claimed on postage and handling (AU$20) or the doctor consultation if you had one (AU$40); and
  • you can only make claims under the Chipper money back guarantee once throughout your lifetime.

PART D – GENERAL TERMS

Limitation of liability

The goods and services offered through our Site come with guarantees that cannot be excluded under the Australian Consumer Law.

 To the extent permitted by law, Chipper’s only liability is as expressly stated in these terms and in the Australian Consumer Law and all other guarantees, warranties and conditions are excluded.

 To the extent permitted by law, including the Australian Consumer Law, in no event will Chipper be liable for any indirect loss, damage or expense – irrespective of the manner in which it occurs – which may be suffered due to your use of our Site and/or the information or materials contained on it, or as a result of the inaccessibility of our Site and/or the fact that certain information or materials contained on it are incorrect, incomplete or not up-to-date.

 To the extent permitted by law, Chipper excludes any liability resulting from the provision of services by third party providers, such as our partner doctors. Liability will rest with the appropriate third party provider and will not under any circumstance rest with Chipper. For the avoidance of doubt and to the extent permitted by law, Chipper excludes any liability resulting from the provision of services by a partner doctor. All partner doctors are solely responsible for the patient’s care.

 Without limiting the application of the exclusions and limitations set out in this section, to the extent permitted by applicable law, under no circumstances will Chipper be liable to you for any of the following losses or damage (whether such losses were foreseen, foreseeable, known or otherwise):

  • loss of emotional well-being;
  • loss of data;
  • loss of revenue or anticipated profits;
  • loss of business;
  • loss of opportunity;
  • loss of goodwill or injury to reputation;
  • losses suffered by third parties; or
  • any indirect, consequential, special or exemplary damages arising from the use of the Chipper service regardless of the form of action.

Privacy and data protection

Chipper has a legal obligation to protect all patient confidential data. Chipper is not allowed to share patient confidential data with third parties, including other doctors, who are unconnected to the Chipper service without your explicit consent. However, to provide the Chipper service to patients it is necessary that both doctors and non-medical staff engaged or contracted by Chipper have access to patient medical records and patient confidential data. It is also necessary that for the purpose of maintaining the Chipper IT systems to provide access to patient data to Chipper’s IT contractors, for the purpose of taking online card payments, and to our pharmacy partners, for the purpose of dispensing the medicine. All access to patient information is kept to the minimum required to allow the safe and effective delivery of Chipper’s services.

 The online nature of the Chipper service necessarily relies upon using electronic forms of communication and post. There are inherent vulnerabilities in using such forms of communication and Chipper is therefore unable to give a guarantee that a third party unrelated to the Chipper service will not intercept communications. Our Privacy Policy was developed to explain: (i) how we store and use, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint.  By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information as described in our Privacy Policy and these terms.

Prohibition and severance

If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reasons of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that Term is illegal, invalid or unenforceable, it will be severed and deleted from the agreement and the remaining Terms will survive, remain in full force and effect and continue to be binding and enforceable. 

Jurisdiction and governing law

Your use of our Site and these terms are governed by the law of NSW and you submit to the non-exclusive jurisdiction of the courts exercising jurisdiction in NSW. 

Other terms and conditions

Additional terms and conditions may also apply to specific portions, services or features of the Site. All such additional terms and conditions are incorporated by this reference into these terms.
